Introduction
The Agreement Between You and Pamclic
These Terms and Conditions ("Terms") govern your use of the websites, software-as-a-service products, desktop and mobile applications, and services ("Services") provided by Pamclic Global Software Private Limited, a company incorporated in India with its office in Salem, Tamil Nadu ("Pamclic", "we", "our", or "us"). "You" means the person or the business that uses the Services.
Please read them with our Privacy Policy and our Refund & Cancellation Policy, which form part of these Terms.
Acceptance of Terms
By Using Our Services, You Agree to These Terms
By creating an account, subscribing, paying, or using any of our Services, you agree to be bound by these Terms. If you are accepting on behalf of a business, you confirm that you have the authority to bind that business. If you do not agree, please do not use the Services. Where you have signed a separate written agreement or statement of work with us, that agreement prevails over these Terms where the two differ.

You agree to use the Services lawfully and not to:
Your Data
You Own the Data You Put In
Everything you enter into our products — your menus, orders, bills, customers, documents and other business records — remains yours. You grant us a limited right to store and process it only to provide, secure and support the Services. We handle personal information as set out in our Privacy Policy. You may export your data while your subscription is active; after it ends we keep it for a limited period and then delete it, unless the law requires us to keep it longer.
Intellectual Property
Our Software Stays Ours
The Services, including all software, designs, logos, trademarks and content we provide, are owned by Pamclic or its licensors. A subscription gives you a limited, non-exclusive, non-transferable right to use them for your own business during the subscription. Ownership of software built specifically for you under a custom development agreement is set out in that agreement.
Third-Party Services
Payment Gateways and Other Providers
Some features rely on third parties, such as payment gateways, SMS and email providers, cloud hosting and printers or other hardware. Their own terms apply to your use of them, and we are not responsible for their availability or conduct. Payments made through a payment gateway are also subject to that gateway's terms.
Availability & Support
Keeping the Services Running
We work to keep the Services available at all times, but they may occasionally be interrupted for maintenance, updates or reasons beyond our control. We will try to give notice of planned maintenance. Support is available by email, phone and the other channels listed below; we typically respond within 24 hours on business days.
Warranties & Liability
The Limits of Our Responsibility
The Services are provided on an "as is" and "as available" basis. To the extent permitted by law, we do not give any warranty that they will be uninterrupted or error-free, or fit for a particular purpose beyond what is described in their documentation. You remain responsible for checking the results you rely on, including bills, tax figures and reports.
To the extent permitted by law, Pamclic is not liable for any indirect, incidental or consequential loss, or for loss of profit, revenue or data. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the twelve (12) months before the claim.
You agree to indemnify Pamclic against claims arising from your breach of these Terms or your misuse of the Services.
Suspension & Termination
Ending the Agreement
You may stop using the Services and cancel your subscription at any time, as described in our Refund & Cancellation Policy. We may suspend or terminate access if you breach these Terms, do not pay amounts due, or if the law requires it. Where possible, we will give you notice and a chance to put things right, and an opportunity to export your data.
Governing Law
Laws of India, Courts at Salem
These Terms are governed by the laws of India. Any dispute that cannot be settled amicably is subject to the exclusive jurisdiction of the courts at Salem, Tamil Nadu.
Changes to These Terms
When These Terms Change
We may update these Terms from time to time. We will post the new version on this page with a new "Last Updated" date, and tell you of significant changes by email or in the product. Continuing to use the Services after a change means you accept the updated Terms.
